Terms of service

Last updated: October 2026

1. Who provides the service

Habita is provided by [Ragione sociale], [Sede legale], [Registro delle imprese e numero di iscrizione], [Partita IVA / codice fiscale dell’impresa]. Contact: [email protected].

2. Nature of the service

Habita is an information society service (D.Lgs. 70/2003) that connects people looking for a home to rent with those offering one. It does not act as a real estate broker or agency, does not represent either party, does not take part in negotiations or in signing the contract and does not receive commissions on rentals.

3. How we rank listings and applicants

People looking for a home only see listings that match the chosen area and radius, their budget, their household income compared with the required minimum, pets and smoking; listings are sorted by distance from the centre of the area and then by most recent. Everyone sees a listing at the same time and nobody pays to rank a listing higher. Landlords see applicants sorted by compatibility score and, when tied, oldest first, with one disclosed exception: for each listing, up to 3 applicants with a Habita Featured subscription and a compatibility of at least 60 out of 100 appear first, labelled “Featured”. Payment does not change the score. You can change these results by editing your area, radius, budget and profile (Regulation (EU) 2019/1150, art. 5, and Directive (EU) 2019/2161).

4. Compatibility and matches

The compatibility score is calculated automatically from the data entered by users and is for guidance only: it doesn’t decide for people. A match happens only if both sides choose it.

5. Identity verification

Publishing a listing requires identity verification through a document and selfie, carried out by the provider Stripe. Verification may be revoked if the personal details in the profile are changed.

6. Profile and photo

Users agree to use a photo that shows themselves and truthful information. Without a profile photo the search and applicant review features are not available.

7. Prohibited content

Habita applies zero tolerance to illegal or abusive content and behaviour. The following are prohibited: fake listings or listings of unavailable properties; requests for money before the viewing and the signing of the contract; offensive, harassing or threatening language; sexual or violent content; exclusions or preferences based on ethnic origin, nationality, religion, gender, sexual orientation, disability or age, even if expressed indirectly; spam and advertising. Before the match, emails, phone numbers or links to external chats cannot be entered in the introduction, title or description. The only requirements allowed in listings are the objective ones provided by the app: income, guarantees, pets, smoking, household composition.

8. Use of other people’s data

The other party’s name, contacts and documents, available after a match, may only be used to assess and conclude the rental. Copying, sharing or using them for other purposes is prohibited.

9. Liability

Users are responsible for the accuracy of the data and documents they upload and of the information about properties. Habita does not survey properties and does not guarantee tenants’ solvency. Never send money before visiting the property and signing a contract.

10. Subscriptions

Habita is free for landlords and for people looking for a home. During the launch period shown in the app we do not sell subscriptions and the “Seen by the landlord” feature is free for everyone. People looking for a home can later activate Habita Featured, a subscription purchased through the App Store or Google Play: their applications appear near the top as described in section 3 and they can see when the landlord has looked at them. Featured does not guarantee a match or a lease. The subscription renews automatically unless cancelled in the store settings at least 24 hours before renewal and is subject to the store’s terms, withdrawal and refund rules. Price, duration and renewal are shown before purchase; the launch price stays the same as long as the subscription remains active. Invites: every user has a code; when someone who entered it within 30 days of signing up verifies their identity to publish listings, the person who invited them receives 30 days of Featured (during the launch they start when it ends), up to 6 rewards. Rewards have no cash value and cannot be transferred; inviting yourself or fake accounts does not qualify for a reward. Sponsored content: some cards and partner offers, for example moving or utilities, are marked “Sponsored” with the partner’s name; any purchase takes place on the partner’s website and is between you and the partner. Agencies can activate a dedicated plan, governed by a separate contract.

11. Reports, blocking and moderation

You can report a listing, an applicant or a user in the chat, anonymously, and block anyone: after blocking, neither of you sees the other any more and the conversation is deleted. We review reports within 24 hours. A listing reported by several people is suspended pending review. If we remove content or restrict an account we tell you the reason, the facts it is based on and whether the decision was automated; you can ask for it to be reviewed by writing to [email protected] within 6 months (EU Regulation 2022/2065, arts. 16, 17 and 20). You can also report content you believe is illegal by explaining why, with your name and email.

12. Business users

Agencies and businesses that publish listings with a VAT number are business users (EU Regulation 2019/1150). Before suspending or restricting their listing or account we state the reasons; permanent closure of the account is preceded by 30 days’ notice, except for serious violations or legal obligations. Changes to the terms are notified at least 15 days in advance. Complaints should be sent to [email protected]: we reply in writing, normally within 15 days.

13. Closing your account

Users can delete their account at any time from the settings. Habita may suspend accounts that violate these terms, stating the reason.

14. Requirements

You must be an adult to use Habita. Anyone publishing a listing declares that they are entitled to rent out the property.

15. Point of contact

For users and authorities the single point of contact is [email protected], in Italian, English or the app’s language (EU Regulation 2022/2065, arts. 11 and 12).

16. Governing law and disputes

Italian law applies. If you are a consumer, the mandatory protections of your country of residence remain in force (Codice del consumo (D.Lgs. 206/2005) for residents there) and the courts of your place of residence have jurisdiction. You can also turn to alternative dispute resolution bodies and to Autorità Garante della Concorrenza e del Mercato (agcm.it).

17. Language

The terms are available in several languages. In case of differences the Italian version prevails, unless the version in your language is more favourable to you as a consumer.

18. Changes

If we change these terms substantially we’ll ask you to accept them again in the app before the changes take effect for you.
